MICO, Inc. (“MICO”) warrants each new product or part thereof supplied by MICO (a “MICO Product”) to be free from defects in material and workmanship under normal use and service according to the following schedule:

• Multiple Disc Brakes: twenty-four (24) months from date of original purchase
• All other products: twelve (12) months from date of original purchase

Any MICO Product that is found to be not in compliance with applicable MICO published specifications for such MICO Product due to a defect in materials or workmanship in normal use will be repaired or replaced with a new or equivalent MICO Product.

In addition, MICO is in no way liable for damages to a MICO Product, user’s property or any personal injuries that are caused by improper installation or use of MICO Products or other causes not due to the fault or negligence of MICO.

This limited warranty and any claims arising from breach of contract, breach of warranty, tort, or any other claim arising from the sale or use of MICO Products shall be governed and construed under the laws of the State of Minnesota. MICO distributors have no express or implied authority to bind MICO to any agreement or warranty of any kind without the express written consent of MICO.

Return Policy

If you believe there is a defect in a MICO Product while such MICO Product is covered under this limited warranty, then you must follow the Returned Goods Procedure set forth below.

If you purchased your MICO Product directly from MICO, or if the distributor you purchased your MICO Product from is no longer in operation, then you must follow the Returned Goods Procedure set forth below. Returns are subject to a minimum 15% restocking fee.

If you purchased your MICO Product through a distributor, then you must contact that distributor to initiate a warranty claim (and the Returned Goods Procedure below will not apply to you).

Returned Goods Procedure

1.   A return goods authorization (“RGA”) number must be included with all MICO Product Returns. The RGA is initiated by going to
      www.mico.com and following the Returned Goods Procedure found under the CUSTOMER SERVICE . . . Returns . . . menu. Or,
     contact your MICO Customer Service Representative (CSR) for assistance.

2.  All MICO Product Returns should be returned freight prepaid.

3.  If MICO determines that a MICO Product covered by this limited warranty is defective, or if MICO otherwise decides to accept your
     claim,  MICO will repair or replace the defective MICO Product. This is the only MICO obligation and the only remedy available to you
     under this limited warranty.

4.  If MICO determines that a MICO Product does not qualify for this limited warranty, you have two options available:

• The MICO Product can be returned to you, subject to a service charge for inspection, cleaning and routine replacement of all rubber components and any other parts that show wear, plus freight; or
• MICO can dispose of the returned MICO Product without compensation to you.

This Limited Warranty Does Not Extend To:

1.  Any MICO Product or Part that has been subject to misuse, tampering, mishandling, neglect, accident, modification or improper
     application, installation or maintenance;

2.  Any MICO Product or Part that has been repaired or altered outside of the MICO plant, unless authorized in writing by MICO or unless
     such installation, repair or alteration is performed by MICO; or

3.  Any labor, travel or installation charges related to the removal and/or replacement of a MICO Product or Part alleged to be inoperative
     or not in compliance with applicable MICO published specifications.

THIS LIMITED WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, ARISING BY OPERATION OF LAW OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MECHANTABLITY AND FITNESS FOR A PARTICULAR PURPOSE AND THE WARRANTY OF NON-INFRINGEMENT. IN NO EVENT WILL MICO BE LIABLE TO YOU OR ANY THIRD PARTIES FOR INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT OR PUNITIVE OR OTHER SIMILAR DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

THE REMEDY SET FORTH ABOVE IS THE EXCLUSIVE REMEDY AVAILABLE TO YOU OR THIRD PARTIES, AND IS IN LIEU OF AND EXCLUDES ALL OTHER REMEDIES, OBLIGATIONS OR LIABILITIES OF MICO FOR DAMAGES, WHETHER IN CONTRACT, TORT OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR ANY DEFECTS IN MICO PRODUCTS OR FOR ANY OTHER INJURY, DAMAGE OR LOSS RESULTING FROM SUCH DEFECTS.
